COMMONWEALTH V. NELSON (2019)

Virginia Beach

DUI and Refusal

Judge Trial

Attorney: George Bruch

The defendant was charged with DUI and Refusal after being alledged to have been involved in a "Road Rage" incident.  After evidence was presented by the Commonwealth, George moved to strike the evidence based on insufficient evidence, citing two cases in Virginia that supported his argument.  George argued that the driver of the vehicle identified could not be identified as his client, basing his arguement on the fact that just because the police found the vehicle at the individuals residence the police failed to take steps to show that the defendant was, in fact, the operator of the vehicle.  The Judge agreed with George's argument and found that the evidence was not sufficient and dismissed both charges, with a finding of NOT GUILTY.
