Virginia Types of Traffic Citations

What are the most common traffic citations in Virginia?

As you can imagine, there are many different types of traffic citations that a person can receive while driving in and around Courtland and Emporia, or anywhere in Virginia for that matter. Not only do Drivers need to be concerned about the traffic laws that the Commonwealth has set forward, but every jurisdiction throughout Virginia has its own standards for handling traffic safety issues.

Virginia classifies traffic violations on a point system, and most violations are considered “three,” “four,” or “six” points, with the severity of the violation increasing at each point. Here, we discuss some of the most common violations at each point level.

Three points

  • Speeding 1-9 mph above the posted speed limit
  • Improper passing violations
  • Improper turning or backing
  • Evading a traffic control device or failure to obey a highway traffic sign
  • Driving without lights or using excessive lights
  • Failure to dim headlights
  • Operating without a driver’s license

Four points

  • Reckless driving
  • Speeding 10-19 mph above the speed limit
  • Unsafe passing
  • Failure to yield to an emergency vehicle
  • Failure to stop for a pedestrian
  • Failure to yield the right of way
  • Failure to drive on the right half has a highway or street
  • Following too closely
  • Improper signaling
  • Failure to obey railroad crossing signal
  • Failure to stop at the scene of a crash

Six points

The following are all classified as felony or misdemeanor reckless driving violations. Some of these may be similar to three- and four-point violations, but are elevated to reckless driving.

  • Racing a vehicle
  • Speeding in excess of 80 mph
  • Speeding 20 mph or more above the posted speed limit
  • Passing or overtaking an emergency vehicle
  • Passing a school bus
  • Driving too fast for conditions
  • Driving while intoxicated by alcohol or drugs
  • Refusing to take a breath/blood test
  • Driving while license is suspended due to DUI
  • Driving on a suspended or revoked license

The amount of time that each violation remains on a person’s driving record varies. However, it is important to understand that points are not the only thing that drivers need to be concerned about. Most traffic violations also come with fines (which can be significant), and some violations come with possible jail time.
